Kevin Greene recently obtained judgment in favor of a major national automobile insurance carrier after a trial in Danbury Superior Court. The case involved allegations of breach of contract, unfair insurance claim settlement practices, bad faith and fraud against the insurer and an affiliated agent related to claims made under a comprehensive automobile insurance policy. The court found all issues in favor of the defendants agreeing with the defendants’ interpretation of the “wear and tear” exclusion in the policy.
