An action was originally filed in Connecticut District Court, between a purchaser of resin and a polymer reseller. Based upon a claim that the resin did not meet specs, plaintiff sought substantial damages under breach of contract, fraud and other tort theories. Our client, a resin supplier, was impleaded by defendant. We are sole counsel for our client in the District of Connecticut, and prepared and filed all pleadings. We moved to dismiss or transfer, based upon the forum selection clause in the applicable documents, which was hotly contested by the Defendant.
Our Motion to Transfer this matter was granted on May 9, 2017. The Third Party action was transferred to the Southern District of Ohio, and was resolved by settlement in 2018.
