Daniel P. Scapellati recently obtained a defense verdict on behalf of an insurer. In Centurion Associates, Inc. v. Sentinel Insurance Company Ltd., NNH-CV13-6037641-S, the plaintiff sought to recover insurance proceeds for the alleged theft and/or unauthorized disposal of business personal property stored in 17 offsite trailers. The insurer challenged the sufficiency of the plaintiff’s evidence and also asserted various policy defenses. The jury found that the plaintiff had not met its burden of proof as to loss or damage resulting from a covered cause of loss that occurred during the policy period. Accordingly, a defense verdict was entered for the insurer on all counts.
