Halloran Sage Obtains Favorable Result in Matter for Korean War Veteran’s Widow

Attorney Logan Carducci achieved a successful outcome recently on behalf of the widow of a Korean War veteran.

 

The veteran suffered a gunshot wound to his right leg in Korea and died in 2013 after unsuccessful surgery on his femoral artery and right leg. The Board of Veterans’ Appeals denied our client’s claim for spousal benefits and refused to consider a letter from her late husband’s doctor that stated his death was service-related.

 

Logan briefed our client’s appeal in the U.S. Court of Appeals for Veterans Claims. In response to her opening brief, the VA’s counsel effectively conceded the issue and agreed to remand the matter back to the Board for them to consider the letter and re-issue a decision.

 

On remand, the Board granted our client’s claim. The final judgment was over $100,000 and included an award of attorney’s fees.
