Halloran Sage is representing an author in connection with the negotiation of a literary agency agreement. The author regularly creates content for academic journals and scholarly publications and most recently, has written a novel. The firm reviewed the agency contract for the marketing and sale of the author’s manuscript which led to negotiation of the scope concerning the agency commissions and marketing rights.
Terms of the original contract were generalized in that the literary agent could receive funds from the author’s prior work as well as future engagements or in the instance that the author were to self-publish. Negotiations were made as to protect the author to properly define the scope of the agency relationship.
