Defense Verdict Obtained in Personal Injury Action

This personal injury action arose out of a motor vehicle collision in Meriden, CT, between the plaintiff, who was riding a bicycle, and the defendant, who was operating a car.

At the time of the accident, the plaintiff was travelling the wrong way on a one-way street. The defendant was stopped at a stop sign, and as she began to proceed into the intersection, the plaintiff came from her left and her vehicle hit the rear wheel of the plaintiff’s bicycle causing the plaintiff to fall from his bicycle onto the street.

At the scene, the plaintiff complained of pain to his left knee and both palms. He was transported by ambulance to the hospital, where he was treated for the abrasions to his knees. For several years following the accident, the plaintiff claimed that injuries and pains and resulting surgical procedures to his head, shoulder, neck, leg and stomach related to the accident. He presented the court with various incomplete medical records and bills in an attempt to substantiate his alleged injuries and damages. His original demand was $20 million and the defendant had a $20,000 liability policy.

The court found that the plaintiff was 51% responsible, and that he failed to prove all of the elements of negligence, thus granting judgment for the defendant.
