Defense Verdict in Alleged Defective Door Case

Jonathan Kelly obtained a defense verdict in a case where a plaintiff tenant severed off the top of his finger while allegedly closing a defective door within an apartment owned by the defendant landlord. While there was some evidence that the door may have been defective, Kelly uncovered evidence that suggested the plaintiff had fabricated the account of his injury and that the door had actually been slammed on his finger during an altercation with a non-party. The jury returned a verdict in favor of the defendant, stating in response to jury interrogatories that they did not believe the plaintiff’s version of events.
