Halloran Sage attorney Kenneth Slater served as environmental counsel to a national builder in a $1 million transaction that involved the sale of 22.63 acres of property containing nine commercial structures. There was anecdotal evidence that certain hazardous wastes were erroneously reported on the property more than a decade ago and the matter brought forth a challenging legal question as to whether the property was subject to the state-law statutory scheme known as the Transfer Act. Based on the favourable environmental investigations, Halloran Sage negotiated a favourable outcome whereby the parties agreed to file under that Act rather than attempt to defend an exemption based on an alleged mistaken characterization of waste. Kenneth also represented the company when the transaction closed.
