Halloran & Sage obtained a favorable decision of the Connecticut Appellate Court reversing a decision of the Superior Court on behalf of our client, the Town of Columbia. The Appellate Court ruled that the Town of Columbia Zoning Board of Appeals correctly determined that a construction business was being operated in violation of the zoning regulations and the zoning permit requirements applicable to the business. Importantly, the Appellate Court found that the contractor yard regulations ruled to be unenforceable by the trial court were, in fact, valid and allowed the regulation of the site contractors construction yard adjoining a residential neighborhood.
