A hospice care provider and sixteen other parties were sued by the mother of a patient, claiming that she was forcibly removed from her terminally ill daughter’s bedside and hospitalized without legal justification. The mother’s forty-two-count complaint alleged causes of action for deprivation of her civil rights, breach of contract, negligence and intentional infliction of emotional distress against the hospice care provider and one of its employees. The complaint also attempted to assert various causes of action on her daughter’s behalf, including wrongful death and murder. In a lengthy and well-reasoned opinion, the District Court dismissed all of the plaintiff’s claims against the hospice care provider, and its employee, with the exception of the cause of action alleging intentional infliction of emotional distress.
