Oscar L. Suarez has been invited to speak at this spring’s ALFA International’s Hospitality & Retail Practice Group Seminar. He will discuss the tort reform Florida enacted last March — what it means and if it affects other jurisdictions.
On March 24, 2023, Florida Governor Ron DeSantis consummated the Legislature’s efforts at passing comprehensive tort-reform legislation (“HB 837/ SB 236”) and, immediately, such action set in motion numerous significant changes to Florida’s legal landscape, particularly for those practitioners in the area of casualty litigation. This panel will explore the finer points of HB 837/ SB 236, the ensuing trends and developments (especially relating to whether and which portions of HB 837/SB 236 have been found to have retroactive application to pending cases) and also how non-Florida practitioners may be able to use some of these arguments and legal theories in support of their cases in other jurisdictions.
Moderating the panel is Andrew Tuttle of Fowler White Burnett P.A. from Miami, Florida. Speaking alongside Oscar are panelists Josh Morris, Claims Manager of Circle K in Raleigh, North Carolina and Andrew Douberly of Dickinson & Gibbons, P.A. out of Sarasota, Florida.
