On the subject of legal issues that employers face in the vaccine distribution process, Arnie spoke from the healthcare law perspective while Duncan and Jen addressed the labor and employment angle.
The article references Arnie’s 33 years of experience in the state attorney general’s office in the context that he “advises healthcare clients to be extra careful with their documentation in anticipation of a day when auditors forget the urgency of the COVID-19 crisis.”
“Every situation is going to be unique,” Duncan said. “When you as an employer are faced with a particular situation it is always prudent to talk with your attorney to do the deep dive with regard to the particular facts and circumstances.”
With the constantly evolving situation that the pandemic presents, Jen pointed out that, “There’s always a new question for us to tackle…One thing that’s going to be really important is that this analysis is going to be different for every single employer and every single employee.”
