Attorney Jennifer Mullen obtained a Defense Verdict in a medical malpractice case in New London.
The plaintiff, a 53-year-old gentleman, alleged that our client, a New London gastroenterologist, failed to immediately refer him to the emergency department when he called to complain of discomfort the day after a colonoscopy and polypectomy.
When the plaintiff appeared in the emergency department two days later, he was found to have a perforated colon.
The plaintiff alleged that due to the delay in follow up care, he lost the opportunity to have the perforation addressed with medical management.
Attorney Mullen proved not only that the gastroenterologist met the standard of care but, that the perforation, a known risk of the procedure, would have required a surgical repair even if the plaintiff had been diagnosed two days earlier, due to his comorbid factors.
