Catino and O’Connell Discuss CT Transfer Act

Attorneys Ann Catino of the firm’s Environmental Practice Group and Casey O’Connell of the Corporate Business & Transactions Practice Group recently taped a 3-part podcast on the topic of the Connecticut Transfer Act, a unique law in CT pertaining to transfers of establishments. Part 1 begins with a review of what the Act is and why some are eager to see the law reformed or eliminated. In Part 2, they continue their discussion with a review of who is responsible for complying with the Transfer Act and in what scenarios. They conclude the conversation in Part 3 with a review of how a deal is structured when you have a site in the Connecticut Transfer Act.

Ann will present on the Transfer Act as a panelist at two upcoming conferences, the CBIA’s 2021 Energy and Environmental Conference on Friday, June 11 and the Connecticut Bar Association’s Connecticut Legal Conference session on Tuesday, June 15.

The CBIA seminar will offer more information about the Transfer Act as well as other State environmental programs. The session is is entitled, “The Transition to the New Release-Based Reporting & Remediation Program: What Happens with the Transfer Act, Brownfields Programs & Then Some?

The CBA session, The End of the Transfer Act, Is It Too Good to Be True? will include a discussion of the status of the Transfer Act, what it covers, and the current exemptions. Recent changes to environmental regulations relating to clean-ups in Connecticut, as well as the recently passed P.A. 20-09 sunsetting the Transfer Act upon the adoption of new Release Based Program regulations will also be reviewed. The panelists will discuss practical ways of handling real estate and business transactions during this transition time.
