Partner Brian Rich managed a matter for an international financial services firm in which a borrower appealed a district court order sua sponte ordering remand of federal litigation to state court to United States Court of Appeals for the Second Circuit. The matter related to a pending state court foreclosure case. Brian and Associate Logan Carducci handled the underlying district court matter and prevailed after oral argument in the Second Circuit on a novel issue of law; namely whether a federal court can order such relief sua sponte, as opposed to on remand motion.
