Medical Marijuana Update: Caye v. Thyssenkrupp Elevator

As indicated in a prior email, in an October 29, 2019 decision the Compensation Review Board ordered the respondents to reimburse a claimant for his expenses associated with obtaining medical marijuana. See Caye v. Thyssenkrupp Elevator, 6296 CRB -1-18-11 (October 29, 2019). The respondents appealed this decision to the Appellate Court on November 15, 2019, but the appeal was subsequently withdrawn on December 3, 2019. Accordingly, under Connecticut law, if a claimant can show compliance with all of the requirements of a marijuana program and provides evidence that marijuana is reasonable and necessary medical treatment, a respondent can be ordered to reimburse the claimant for the expenses associated with obtaining this prescription.
